Water Wallet Terms and Conditions

These Terms and Conditions apply when you create a Water Wallet account, register a student or staff member, purchase products, add refill credit or use a Water Wallet refill machine.
By creating an account or using Water Wallet, you agree to these Terms and Conditions.
1. About Water Wallet

In these Terms, “Water Wallet”, “we”, “us” and “our” refer to the entity identified above.
“User” means a student, teacher or staff member registered to use a Water Wallet machine.
“Account holder” means the parent, guardian, teacher, staff member or other authorised adult who creates and manages a Water Wallet account.
2. Eligibility and authority
You must be at least 18 years old and legally capable of entering into an agreement to create an adult Water Wallet account.
When adding a child, you confirm that:
- you are the child’s parent, legal guardian or otherwise authorised to manage the child’s Water Wallet profile;
- the information you provide is accurate;
- you are authorised to make decisions relating to the child’s use of Water Wallet; and
- you will keep the child’s profile information reasonably up to date.
We may ask for reasonable proof of your authority where necessary.
3. How Water Wallet works
Water Wallet is a prepaid refill system.
Each registered user is issued with or linked to a compatible RFID or NFC access device, such as:
- a Water Wallet tag;
- a silicone wristband; or
- another compatible device approved by Water Wallet.
The access device identifies the registered user when it is tapped at the Water Wallet machine.
No wallet balance, payment-card information or detailed personal information is stored directly on the physical tag or wristband. The access device is linked to the user’s Water Wallet profile within our system.
4. Family wallets
A Water Wallet account may contain one shared family wallet.
Multiple children or users linked to the account may spend from the same wallet balance. Each refill is nevertheless recorded against the individual user who tapped their access device.
Wallet credit:
- is prepaid;
- may only be used for eligible Water Wallet refills;
- is not a bank account or credit facility;
- does not earn interest;
- cannot ordinarily be exchanged for cash; and
- remains available until used, unless the account is lawfully closed or a different rule is clearly communicated before purchase.
5. Refill prices and bundles
The current refill price is displayed during registration, on the website or at the machine.
At launch, the intended refill price is R3 per refill.
Available refill bundles may be described by their approximate duration or number of refills, for example:
- monthly bundle for one child;
- monthly family bundle;
- term bundle for one child; or
- term family bundle.
These descriptions are estimates based on assumed school attendance and refill habits. A bundle does not guarantee that it will last for a specific calendar period.
The wallet is charged according to actual use.
We may change refill prices or bundle options. Where practical, we will communicate material price changes before they take effect.
6. Initial tags, wristbands and replacements
Each newly registered user may receive one standard initial RFID tag free of charge, subject to the applicable school programme.
Instead of the free standard tag, the account holder may choose a paid wristband or another upgraded access device where offered.
Current intended pricing includes:
- initial standard RFID tag: free;
- replacement standard RFID tag: R15;
- silicone wristband: displayed price at the time of purchase.
Replacement prices may change and will be shown before purchase.
If an access device is lost, stolen or damaged, the account holder should report it promptly. We may suspend or deactivate the previous device before activating a replacement.
The wallet balance and transaction history remain linked to the user’s account and are not stored solely on the physical access device.
7. Bottles and accessories
Users may use their own suitable reusable bottle, provided that it:
- fits safely beneath the machine nozzle;
- has sufficient available capacity;
- has an opening suitable for filling;
- can be positioned securely; and
- is clean and fit for drinking-water use.
Where offered, Water Wallet may sell school-branded bottles, lanyards and other accessories.
Product descriptions, images and mock-ups are intended to represent the product as accurately as reasonably possible. Minor variations in colour, engraving, printing, materials or appearance may occur.
8. Bottle capacity and dispensing
The standard Water Wallet bottle is intended to hold approximately 500 ml.
Users who bring their own bottles are responsible for ensuring that the bottle has enough available space before starting a refill.
The quantity dispensed by a machine may be calibrated separately from the nominal capacity of the bottle. The final dispensing volume and refill instructions will be displayed at or near the machine.
9. Orders and payment
Orders are only confirmed once:
- the checkout process has been completed;
- payment has been successfully authorised, where payment is required; and
- we have issued an order confirmation.
Prices are shown in South African rand and will state whether VAT is included where applicable.
Payment processing may be provided by a third-party payment gateway. Water Wallet does not ordinarily store complete bank-card details.
10. Collection and delivery
Unless otherwise stated, programmed access devices and physical products will be delivered to the collection point shown during registration, usually the relevant school reception.
The school acts as a collection point and is not necessarily the seller or manufacturer of the products.
We will notify the account holder when an order has been programmed, dispatched to the school or made ready for collection.
Collection times are estimates and may be affected by:
- product availability;
- school schedules;
- supplier lead times;
- engraving or branding requirements;
- payment delays; or
- technical problems.
11. Product availability and school branding
School-branded products are specific to the selected school.
A product branded for one school may not be exchanged for a differently branded product after engraving or customisation has begun, unless the product is defective or applicable law requires otherwise.
Made-to-order or customised goods may be subject to different cancellation rules from standard stocked products.
Nothing in these Terms removes rights that consumers may have under the Consumer Protection Act. The CPA seeks to promote fair consumer transactions, adequate product information and protection against unfair business practices.
12. Cancellations, returns and refunds
Requests to cancel or amend an order should be sent to admin[at]waterwallet.co.za as soon as possible.
A refund or exchange may be available where:
- a product is defective;
- the wrong product was supplied;
- a product does not materially match its description;
- an order has not yet entered custom production; or
- applicable consumer law requires a refund or other remedy.
Custom-branded, engraved, programmed or personalised products may not be returnable merely because the customer changes their mind, where this is permitted by law.
Approved wallet refunds, if any, may be subject to:
- verification of the account holder;
- deduction of amounts already spent;
- reversal of payment-gateway charges where lawful; and
- reasonable processing requirements.
Refund decisions will not limit any non-excludable rights under South African law.
13. Machine availability
We aim to keep Water Wallet machines functioning and available during the applicable school’s operating periods.
However, uninterrupted access cannot be guaranteed. A machine may temporarily be unavailable because of:
- planned maintenance;
- filter or component replacement;
- electricity or network failure;
- water-supply interruption;
- school closure;
- safety concerns;
- vandalism or misuse; or
- circumstances beyond our reasonable control.
A temporary outage does not cause wallet credit to expire.
14. Safe and acceptable use
Users must:
- follow the instructions displayed on the machine;
- use a clean drinking bottle;
- keep the bottle correctly positioned;
- avoid touching the dispensing nozzle;
- not tamper with the machine;
- not attempt to access internal components;
- not lend an access device where doing so may cause misuse;
- report faults or leaks to the school or Water Wallet; and
- use the system only for its intended purpose.
We may suspend an account or access device where there is suspected fraud, tampering, abuse, unauthorised access or a safety risk.
15. Account security
The account holder is responsible for:
- keeping login details confidential;
- using a reasonably secure password;
- notifying us of suspected unauthorised access;
- keeping contact information current; and
- logging out from shared devices.
You must notify us promptly if an access device, password or account may have been compromised.
16. Communications
We may send essential service communications concerning:
- account creation;
- password resets;
- payments;
- wallet transactions;
- orders;
- product collection;
- tag programming;
- lost or replacement devices;
- machine service notices; and
- material changes to the service.
These operational communications are not optional marketing messages.
Marketing emails will only be sent in accordance with applicable law and the choices recorded on your account. Marketing consent may be withdrawn at any time.
17. Intellectual property
The Water Wallet name, software, website design, graphics, content and associated branding belong to Water Wallet or its licensors.
School names, logos and crests remain the property of the relevant school or rights holder and are used with permission where required.
You may not copy, reproduce, sell or commercially exploit Water Wallet materials without written permission.
18. Liability
Water Wallet will take reasonable steps to operate the service safely and accurately.
To the fullest extent permitted by law, we are not responsible for indirect or consequential loss arising from:
- a temporary machine outage;
- loss of an access device;
- misuse of a bottle or machine;
- inaccurate information supplied by an account holder;
- school closure or restricted access;
- third-party payment or communications failures; or
- circumstances outside our reasonable control.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including applicable consumer-protection rights.
19. Changes to these Terms
We may update these Terms from time to time.
The latest version will be published on the Water Wallet website with its effective date. If a change materially affects existing users, we will take reasonable steps to communicate it.
20. Governing law
These Terms are governed by the laws of the Republic of South Africa.
Any dispute will be handled by a court or tribunal with lawful jurisdiction, subject to any consumer rights to approach the National Consumer Commission, Consumer Tribunal or another appropriate body.
